While I think there are certainly cases of economists stepping on the toes of historians as far as the claim of novelty over research findings, what best illustrates the material difference is in the use of the term confirmed. As far as the paper in question, there is a qualitative identification of a legal phenomena and change over time, but without a model or more robust empirical strategy it fails to fully express or "confirm" the causal mechanism and remains more of a stylised fact. Rather than a mathematical rearticulation of existing historical research, my paper serves as an extension aiming to achieve a narrower standard of evidence in order to express an economic process and not just an observed outcome.

The paper referenced in my original post proposes that a break in legal precedent occurred earlier than most historical accounts, employing a qualitative analysis of court filings and written decisions as evidence. My paper draws a similar conclusion but uses a mathematical model to effectively illustrate the incentives that resulted in the early emergence of this new precedent as an endogenous, self-enforcing contract, generating a series of testable hypotheses. Same findings, very different papers.

Economists can be guilty of dismissing the methodological practices of other disciplines, but developing a theory through qualitative analysis is meaningfully different from formal modelling and causal identification, such that the latter represents a novel research contribution.
