Non-Australians, PLEASE READ THIS: This genuinely could be the worst ever woke/progressive legal decision in the history of the entire Western world. The High Court of Australia just ruled that the Australian government may be forced to pay tens of millions of dollars to foreign CONVICTED rapists, pedophiles and murderers. How on Earth did this happen? The High Court of Australia ruled that foreign non-citizens convicted of crimes like rape, murder and pedophilia in Australia can sue the Australian government for millions of dollars in compensation for subjecting them to ''false imprisonment'' in immigration detention. The lead plaintiff in this particular case was Safwat Abdel-Hady, a Gaza-born businesman with an Austrian passport initially convicted for spiking drinks with intent to commit an act of indecency, which, on retrial, become a conviction on a lesser charge - he pleaded guilty to using poison to endanger life or inflict grievous bodily harm. Mr Abdel-Hady mixed a woman a strong cocktail containing the sleeping pill Stilnox. The woman told courts she awoke to find Mr Abdel-Hady assaulting her as her partner slept in another room. After leaving his home her and her partner went to hospital and blood tests showed the couple had traces of Stilnox, cocaine and very high readings of alcohol. Former Labor Prime Minister Bob Hawke attended Abdel-Hady's appeal and wrote a character reference saying he had often entertained him at his home. They were reportedly long standing friends and business partners. He was subsequently convicted of multiple assaults and subjected to an apprehended violence order. Courts found that he could not be deported to Austria following the legal decision because his blood clotting condition rendered him medically unfit to travel by any commercial aeroplane, meaning there was no reasonable prospect of his removal. The High Court of Australia has now ruled that Safwat Abdel-Hady can sue the Australian government for false imprisonment for keeping him in immigration detention awaiting deportation, a decision which opens the door to tens of millions of dollars in compensation claims arising from the ''NZYQ Cohort'' of convicted criminals who were in turn kept in immigration detention while awaiting deportation. The High Court of Australia ruled in the ''NZYQ Case'' that foreign non-citizens convicted of crimes like rape, murder and pedophilia could not be held in indefinite immigration detention while awaiting deportation because the indefinite detention violated the Australian Constitution in the sense that it was ''punitive'' and ''beyond legislative power.'' As non-citizens, they were slated for deportation at the end of their prison terms but could not be deported due to a mixture of fake asylum claims, medical conditions which apparently precluded deportation, the prospect they could face the death penalty in their home countries, and so on. So the Australian government kept them in indefinite immigration detention for community safety. The High Court of Australia ruled in NZYQ v Minister for Immigration that these people could not be held in immigration detention where there’s no real prospect of deportation due to fake asylum claims, medical conditions which apparently preclude deportation, the prospect they could face the death penalty in their home countries, and so on. So they were all released. Here’s a breakdown of their convictions prior to their release onto the streets of Australia: - Murder or attempted murder: 7 - Sexual offending (incl. child sex offences): 37 - Assault/violent offending, kidnapping, armed robbery: 72 - Domestic violence & stalking: 16 - Serious drug offending: 13 Within weeks of the release, multiple members of the NZYQ cohort reoffended with new rape offences. In all, 104 of the 300 released men ultimately reoffended - 21 breaching visa conditions plus committing an offence, 83 charged with state or territory criminal offences, including the alleged bashing and robbery of 73-year-old cancer ridden Perth grandmother Ninette Simons. One former detainee, a Sudanese born man named Masi Ayiik, was shot by Victorian police after allegedly running at them with a metal pole in Melbourne's southeast. He was in the community on five counts of bail and had allegedly breached visa conditions twice, having originally faced deportation for serious criminal offences. The Human Rights Law Centre (HRLC) and major corporate law firm Allens did pro bono legal work to free these foreign child sex offenders, rapists and murderers and put them back on our streets to committ new heinous criminal offences. What noble work. What a beautiful use of their limited valuable time. A High Court judgment summary ultimately confirmed that the lead plaintiff in the NZYQ case (a stateless Rohingya refugee) had a child sexual offence conviction; the court held his ongoing detention was unconstitutional because removal wasn’t reasonably foreseeable given the prospect that he would be persecuted as a Rohingya in Myanmar. That ruling prompted the wider releases. Other cases involved rape, sexual assault of a 12-year-old, assault of an eight-month-old, drug smuggling. Now the High Court has ruled that the NZYQ cohort rapists, pedophiles and murderers who were kept in immigration detention while awaiting deportation can sue the Australian government for false imprisonment, potentially leading to claims running into the tens of millions of dollars. So the timeline here is the following: 1. Rohingya refugee convicted of child sex crimes argues that he cannot be deported to Myanmar because he faces persecution. 2. Australian government decide to keep him in indefinite immigration detention due to fears for community safety. 3. Progressive law firms champion the cause of this convicted foreign pedophile and argue for his release. 4. High Court rules that he must be released from indefinite immigration detention alongside hundreds of other hardened violent foreign criminals. 5. 300 violent foreign criminals are released, almost 100 of them immediately reoffend with violent crimes such as rape and the bashing of a 73 year old grandmother with cancer. 6. Seperately, a Gaza born foreigner is convicted of using poison to endanger life or inflict grievous bodily harm. A woman testifies that she woke up to him attempting to rape her after being drugged. 7. Former Labor Prime Minister Bob Hawke attends his appeal and writes a character reference for him. 8. Courts rule he cannot be deported due to blood clots preventing him using commercial planes. Government keeps him in immigration detention for community safety. 9. He sues for false imprisonment, opening the door to hundreds of hardened foreign violent rapists, pedophiles and murderers suing the Australian governmrent for false imprisonment. 10. The Australian government now must use our taxpayer money to pay tens of millions of dollars to foreign convicted rapists, pedophiles and murderers. It's just incredible. You could not make this up. Also, in researching this post I discovered a case where a Vietnamese drug trafficker (DBD24 in High Court files) who was released from immigration detention on a protection visa because he argued that he faced the death penalty in Vietnam for trafficking. Lol. Lmao. We are literally the dumping ground of the world.

CGT: Australia's Great Mining Giveaway: 86% Foreign Owned. 47%+ Taxed at Home. x.com/goodfoodgal/st… I'm going to explain why we are the Lucky Country's Last Generation. Singapore's Lee Kuan Yew once said: "Australia was indeed a lucky country with an embarrassment of riches" and was "A relaxed, not an intense society." We no longer own the majority of those "embarrassment of riches", and that "relaxed not intense society" has allowed our politicians to adversely tax our own population while making it progressively easier for foreigners to have the windfall profits, and progressively own Australia's assets. To illustrate, let's look at how the proposed CGT system works with our mining sector. Firstly let's totally stun you by looking at the ownership of Australian mining companies....Treasury's own figures confirm our miners are 86% foreign owned... WTF! australiainstitute.org.au/post/australia… If you look at every $100 generated by mining company, $30 goes in wages and production, $30 is swiped by state and federal governments (eg royalties), $15 goes to foreigners, $15 goes to suppliers and businesses, and finally $10 goes to Australian shareholders. That's before we are taxed. Yep, $10. And now the government wants to slap you with the full blown capital gains tax of 47% on that measly amount of capital gain. Now those fellas overseas are not going to be paying that, they are probably paying nothing. And it doesn't stop there, while most Australians pay around 45c per litre in fuel tax, mining companies usually pay nothing, a tax break worth over $3.5 billion to the mining industry each year. A mining industry that is not predominantly owned by Australian companies. As a proportion of total employment in the country it's about 2%, so they're hardly big employers, compared to over 2 million in health related jobs. In fact if you look outside of the royalties paid by the miners, as a proportion of overall tax take very little comes from them. Over the last decade the mining industry paid $254 billion in tax, while total government revenue reached almost $6.8 trillion. So proportionally they pay sweet bugger all. Who pays the majority of tax? You do, predominantly income tax. Now they want to shaft you with unprotected capital gains tax as well. Part of the reason that all this happens is that we are led by people in the video below. Our politicians tend to be lifelong political hacks, union hacks, occasional lawyers, but almost never successful business people, engineers, doctors, or other technocrats that actually do things to create value. Almost never. In comparison,China and Singapore go to a great deal of trouble to make sure that their government executive has technocratic skill, as you can see here x.com/toy59496/statu… All of that mining revenue has not produced a sovereign wealth fund for our descendants, or even a budget surplus for us, but is simply used up on social spending like NDIS. It's a non renewable resource and when it's gone it is gone, and it shows our great contempt for the next generation, and future generations, who will see us as the self-centered halfwit generation who sold them down the river while letting foreigners bask in the bounty of the time. I don't think this is assisted by having a country where a third of the population were not born here which must at some level weaken our collective intention to look after the integrity of our future generations. If it goes crap they'll just move back. Usually they have somewhere to move back to... We do not. So now the government wants to tax us more, so we have almost the highest tax rate in the world on income, and with what pitiful residual we get to keep to invest, we then get the highest capital gain tax rate in the world. While foreigners who not only own 86% of our mining companies pay nothing for their capital gain. Obviously that ownership will increase and it is probably so high already because of these asymmetric taxation incentives. I mean how much is left not to own? Ultimately the good decisions of many of our potential adversaries is infinitely wiser than our own. We will lose the economic war. Because we are led by people like our finance minister below.

CGT: ATO says extra $50b to spend on Labor's Social State The ATO has made a submission to the Senate Inquiry into CGT, somewhat to my surprise. They report that in 2022-23 there was $45.2b in CGT discounts. It must be well over $50b three years further along. That's what the ATO says and the ATO would know. It's just a basic unconscionable grab of a huge amount of money to support their unchecked and unaudited spend. It's so unconscionable that makes me feel a little sick.

Thanks, Labor, for the masterclass in democratic engagement—squeeze the peasants while giving yourselves a nice buffer. The Committee gets one business day after the hearings to spit out a report? Mate, that’s not scrutiny; that’s a drive-thru rubber stamp. This is a Breach of Trust, Pure and Simple Labor promised before the election they wouldn’t touch CGT like this. Now here we are, post-Budget, with a rushed bill that guts the 50% discount Australians have relied on for decades to encourage investment, risk-taking, and building wealth. This isn’t “reform”—it’s a bait-and-switch that punishes people who work hard, save, invest in shares, property, or businesses, and try to get ahead. My grandfather worked on tanks during the Second World War—not fighting on the front lines, but doing his bit in the factories to keep the war machine running so we could have a free country. He’d be turning in his grave right now. He fought (and worked) for an Australia where you could own something, build something, and pass it on—not this slow march toward the government owning everything through the tax system. This bill is Un-Australian to its core. Communism by Stealth – or Just Pure Economic Idiocy? Call it what you want: communism by stealth, class warfare dressed up as “fairness,” or the clueless ramblings of people who’ve never run a business or risked their own capital. This change—indexing the cost base for inflation while slapping a 30% minimum tax on real gains—will hammer investors, small business owners, farmers, and anyone with super or shares. It shows a complete lack of understanding of basic economics. Capital gains aren’t “unearned” income—they’re the reward for deferring consumption, taking risk, and allocating capital productively. Punish that, and you get less investment, less growth, lower wages, and fewer opportunities. Houses get more expensive for first-home buyers because supply dries up. Startups struggle to attract talent with equity. Retirees get squeezed. Is this intended to destroy our economy for nefarious reasons? Or is it driven by pure idiocy and ignorance? Either way, it’s a disgraceful tax. The government talks about housing affordability while making property investment less attractive and negative gearing changes that funnel money into new builds only. Brilliant—because nothing says “fix the housing crisis” like discouraging existing stock turnover and punishing mum-and-dad investors. Allow Me to Illustrate (in Fair Dinkum Terms) This is like the government looking at a successful Aussie who built wealth through hard yakka and saying, “Nice nest egg you’ve got there... it’d be a shame if inflation + our new rules ate most of it.” Or telling a farmer who held land for 30 years: “Congrats on the gain! We’ll index the dirt for CPI, but don’t forget the 30% floor so we still get our cut.” It’s the economic equivalent of your mate who borrows your ute, crashes it, then sends you a bill for the petrol he used on the way to the wreckers. We already have one of the highest marginal tax rates in the world combined with this. Now you’re effectively raising it further on capital. Genius. What’s next—taxing the air we breathe because it has “appreciated” in value? Conclusion and Urgent Request This rushed process is an insult to proper governance. Major tax reform deserves months of consultation, not a few days squeezed around a long weekend. I urge the Committee to recommend rejecting or significantly amending these CGT provisions. Protect the 50% discount, scrap the arbitrary 30% floor, and stop this attack on aspiration. Australians deserve better than being treated like cash cows for endless government spending. The point isn’t that nurses pay too little (in fact taxes on wages are too high). It’s that simplistic comparisons between annual wage income and long-term capital gains ignore risk, timing and inflation. And they’re being used dishonestly in this debate.
