Las pruebas obtenidas son de hace cinco años en Miami, de la agencia estadounidense de control fronterizo, que las obtuvo del volcado del móvil del empresario venezolano Rodolfo Reyes, con una mera autorización genérica para controlar todos los dispositivos electrónicos en los puertos de entrada a EEUU. Imposible de hacer en ningún país de la UE sin autorización expresa judicial. Ahora el juez pregunta a la administración de EEUU si lo que han mandado tiene respaldo legal o judicial, si fue custodiado convenientemente, si tienen el aparato físico para contrastar el clonado y evitar manipulación. ¿Ahora? Parece evidente además que si el clonado se hace para luchar contra el terrorismo, drogas y demás, a Rodolfo Reyes no debieron encontrarle nada porqué se fue de rositas. ¿Recordáis el caso Naseiro? En 1990, unas escuchas telefónicas realizadas en una investigación por narcotráfico destaparon conversaciones que apuntaban a posibles comisiones, adjudicaciones amañadas y financiación irregular en el PP. Las grabaciones eran tan comprometedoras que el caso provocó un enorme terremoto político. Pero nunca hubo juicio sobre el fondo de aquellas conversaciones. ¿Por qué? Porque el Tribunal Supremo anuló las escuchas al considerar que habían sido autorizadas para investigar narcotráfico y no financiación ilegal. Alucina vecina! Las pruebas quedaron invalidadas y el procedimiento terminó archivado. Es decir: no se declaró que lo que se escuchaba fuese falso. Se declaró que esas pruebas no podían utilizarse judicialmente porque se habían obtenido vulnerando garantías fundamentales. Años después llegaron Gürtel, Bárcenas y las condenas por la caja B del PP. Por eso resulta curioso escuchar hoy a quienes sostienen que una investigación debe darse por buena simplemente porque existen clonados ilegales de móviles, grabaciones, filtraciones o indicios. El Estado de Derecho funciona precisamente al revés: las garantías procesales valen para todos.
